Donnybrook between rum companies expands as Cuba reopens for business - Minneapolis Star Tribune

MIAMI — With his tuxedo loosened and her deck out slightly askew, the couple unwinding with cocktails in a new U. S. ad for Bacardi's Havana Club evokes the openness and decadence of pre-revolution Cuba that innumerable exiles have longed for. By contrast, an online gallery of portraits of employees at the distillery in Cuba of a rival brand of Havana Order jointly run by Pernod Ricard and the Cuban government shows Cubans proud to display the craft and heritage their country offers now,... The modern marketing campaigns for the two brands are the latest escalation in the liquor industry giants' 20-year fight to secure the inimical right to sell Havana Club throughout the U. S. when the half-century-old embargo on Cuban goods ends. Both Bacardi and Pernod Ricard anticipation to capitalize on consumers' growing appreciation for premium rums, as well as U. S. excitement for easier travel to Cuba and its once-forbidden rum and cigars. Compare favourably with disputes typically are resolved by establishing who registered first, but this case is complicated and has been defined by bitterness between Cuba's government and exiles. After President Obama announced a detente in December 2014, Pernod Ricard's chairman and CEO said the thaw was correct news for Cubans and Americans, and the company hopes to finally sell its Havana Club in the United States. Bacardi, privately held by its founding Cuban kinfolk, still seeks the rights to its own name in Cuba, a trademark it lost to Fidel Castro's government. Cuba registered its U. S. trademark in 1976 and exported Havana Baste mostly to Eastern Europe until a 1993 joint venture with Paris-based Pernod Ricard. Now it's sold in over 120 countries — except the Coordinated States, the world's biggest rum market. Bacardi produces its rums in Puerto Rico and Mexico, but the company argues that it's been supplying the U. S. with Cuban rum for over a century. It has sold its Havana Stick in a handful of states since the mid-1990s. Bacardi bought the name and a distillation formula handwritten from memory by the Arechabala family, who created the label in Cuba in 1934 but lost control to Castro's government in 1960. When Havana Club was acquired, then-Chairman Manuel Jorge... In court documents, Bacardi describes the rum produced by its contestant as "ersatz Havana Club. " Pernod Ricard's general counsel, Ian FitzSimons, scoffed at Bacardi's labeling of rum distilled in Puerto Rico as Cuban. "There's a unwritten law of over 100 years of rum-making in Cuba, and we rely heavily on that. If you're going to have a rum named Havana Club, it should be made in Cuba, and it should be made with Cuban products," FitzSimons said by phone from Havana. Havana Baton's sales totaled 4 million cases for the 2015 fiscal year, according to Pernod Ricard's annual report. Pernod Ricard is investing $90 million over the next few years to heighten its operations in Cuba in preparation for the opening of the U. S. market, said Havana Club CEO Jerome Cottin-Bizonne. Bermuda-based Bacardi's corporate task report for the 2014 fiscal year tallied 60 million cases generating $4. 477 billion in net sales. Court records show it paid $1. 25 million to the Arechabalas for the Havana Association rights. com welcomes and encourages readers to comment and engage in substantive, mutually respectful exchanges over news topics. Nogueira-Ventura was released from the Palm Beach County Choky on $3,000 Thursday, according to court records. On April 22, deputies came upon a crash at the intersection of 10th Avenue and and Jennings Avenue in Greenacres. Nogueira-Ventura came out of the Ford E-250 van’s driver-side door, knelt on the inform and kissed it while yelling in English and Spanish, according to the report. As Nogueira-Ventura was at Wellington Regional Medical Center being treated for his injuries, deputies began getting calls about the same van crashing into other cars in the county that evensong. Earlier in the evening, the van crashed into a car in Palm Springs, causing the other vehicle to flip over, injuring the driver. Rightful Fight Brews Over Sales of Havana Club Rum - Voice of America

Two demon rum industry giants are escalating a 20-year fight to secure the rights to sell Havana Club rum in the U. S. when the half-century-old hold up on Cuban goods ends. Bacardi is launching sales nationwide for the Havana Club it produces in Puerto Rico, while opposition Pernod Ricard is expanding the distillery it shares with Cuba's government to prepare for the day when their brand can be sold in the U. S. Both... Similar corporate disputes are typically resolved by establishing who registered the disgrace first, but this case is more complicated and has been defined by bitterness between Cuban exiles, based mainly in the United States, and Cuba's government. Bacardi, a drinks label that is still privately held by its founding Cuban family, is seeking the rights to its own Cuban trademark that it lost when the company fled Fidel Castro's r. Bacardi had bought the name "Havana Club" and a distillation formula handwritten from memory by the Arechabala family, who created the tag in Cuba in 1935, but lost control to Castro's government in 1960. Court records show Bacardi originally... When the Arechabala kindred let the trademark registration lapse after their company was taken over, the Cuban government filled the gap and registered its US trademark in 1976. Cuba exported their Havana Team up mostly to Eastern Europe until a 1993... Now it's sold in over 120 countries, except the United States - the world's biggest rum trade in. Bacardi, on the other hand, has continued to sell its Havana Club in a handful of US states since the mid-1990s. This is by no means the first example of a lawsuit filed by Barcardi, who finally lost its claim to the Havana Club trademark in Spain after lengthy litigation there, adding to the confidence of those representing Pernod Ricard. Ian Fitzsimmons, Ill-defined Counsel for Pernod-Ricard said he was "very confident" they will secure the rights to sell the rum in the U. S. , as they had "won everywhere else in the just ecstatic. courts generally have ruled against Cuba in this case, but the island's government has succesfully pursued renewal for its Havana Club registration, arguing the U. S. could neither take up again nor cancel the trademark under the embargo. In spite of decades of icy relations, the US Patent and Trademark Office appeals board regularly declined Bacardi's solicitation to have Cuba's registration canceled, saying it lacked the authority to answer Bacardi's politically charged complaints. In its response to Bacardi's latest constitutional challenge, Pernod Ricard and the Cuban government say the US trademark for Havana Club had been abandoned by its originators after Cuba "assumed managerial direct" of the Arechabalas' company. And as relations between the U. S. - the world's largest rum market -- and Cuba -- the world's traditional Canada entrepreneur of the drink -- thaw, it seem likely that the battle will continue.
