Nemesis of Lansdale man accused of killing co-worker at Franconia meat plant in hands of jury - Montgomery Newspapers

NORRISTOWN >> The finish of a Lansdale man accused of fatally stabbing a co-worker during an altercation at a Franconia meat packing plant is now in the hands of a Montgomery County jury. That jury deliberated about 20 minutes overdue Thursday afternoon before deciding to call it quits for the day during the trial of Peter Jok Atem, 33, of the 300 block of Cannon Avenue, who faces charges of at the outset- and third-degree murder, as well as... 18, 2015, stabbing death of his co-worker, 25-year-old Danny Vazquez, at the MOPAC Portrayal plant in the 700 block of Souder Road, Franconia. First-degree murder, punishable of life imprisonment, is an intentional stroke of luck while third-degree murder, punishable of up to 40 years in prison, is a killing committed with malice, or a hardness of heart or bear in mind disdain for the consequences... The judge also instructed the jury on a charge of voluntary manslaughter, at the request of defense lawyers. Spontaneous manslaughter, a killing that occurs when there is an unreasonable, mistaken belief that one’s actions are justified, is punishable of a maximum of 10 to 20 years in house of correction. Atem remained expressionless as testimony wrapped up and lawyers in the case gave their summations to the jury on Thursday. After lengthy discussions with his lawyers, Atem undisputed not to testify during the trial. Assistant District Attorney Alec O’Neill argued Atem, who allegedly stabbed Vazquez nine times, had the individual to intent to kill Vazquez and sought a conviction of first-degree murder. “A deadly weapon on a vital part of the substance, that’s specific intent,” O’Neill, assisted by co-prosecutor Heather Hines, argued to the jury, adding testimony revealed Vazquez was unprotected and stabbed in the neck, chest and arm. O’Neill argued Atem’s intent was evident in his actions - showing up at the plant on a day he was not supposed to be there, walking to a locker without clocking-in to be repaid his personal butterfly-style knife, walking to the rendering filter... Witnesses testified the altercation occurred after Atem entered the leach room, approached Vazquez, who was seated in a chair, and “started roughing him. Vazquez, according to testimony, asked Atem the reason for the charge and threatened to go to a supervisor’s office and report it. A short time later a witness heard Vazquez scream and turned to see Atem stabbing an defenceless Vazquez. 1 2 3 See Full Story O’Neill implied Atem’s conduct was willful and deliberate. But defense lawyer Benjamin Cooper, assisted by co-defense solicitor Megan Schanbacher, argued Atem did not have specific intent to kill and suggested jurors should also consider the charge of voluntary manslaughter. Cooper suggested Atem “misunderstood the kettle of fish” during the altercation with Vazquez, and believed he was acting in self-defense, although that belief was unreasonable. Defense lawyers argued Atem suffered lively symptoms of post-traumatic stress disorder, which affected his state of mind at the time of the altercation, due to traumas he experienced as a girl refugee in Africa. Cooper argued Atem’s conduct was “so off the wall. He was sick, very, very sick,” Cooper argued to the jury. Atem had a horrific teens. A defense psychiatrist, Dr. Alisa R. Gutman, testified during the trial that it was her opinion Atem was actively suffering from post-traumatic emphasis and that his. Source: www.montgomerynews.com

VIDEO: Lansdale man convicted of 1st step by step murder in co-worker's death - The Mercury

Peter Jok Atem, 33, of the 300 block of Cannon Avenue, was convicted Friday of outset-degree murder, which is an intentional killing, and possessing an instrument of crime in connection with the 8:08 a. m. Feb. 18, 2015, stabbing death of his co-woman, 25-year-old Danny Vazquez, of Philadelphia, at the MOPAC Rendering plant in the 700 block of Souder Road, Franconia. This was the outgrowth that the facts supported and certainly the law supported as well,” added Assistant District Attorney Alec O’Neill. “I’m glad that the sacrificial lamb’s family has seen the justice that I believe he deserved. By convicting Atem of the most serious murder-related charge, jurors rejected defense pleas for a sureness of one of the lesser charges of either voluntary manslaughter or third-degree murder. Voluntary manslaughter is a killing that occurs when there is an unreasonable, flawed belief that one’s actions are justified, while third-degree murder is a killing committed with malice. “There was a series of decisions that showed the defendant was acting intentionally, not under the strain of any kind of illness or disease, but for whatever reason, and to this day we don’t know exactly why, but we do know that he was doing... At trial, O’Neill argued Atem’s avid was evident in his actions — showing up at the plant on a day he was not supposed to be there, walking to a locker without clocking-in to retrieve his personal butterfly-style knife, walking to the conception... Witnesses testified the altercation occurred after Atem entered the filter room, approached Vazquez, who was seated in a moderate, and “started roughing him. But Cooper, assisted by co-defense lawyer Megan Schanbacher, argued Atem did not have specific intent to dispatch and suggested jurors should also consider the charge of voluntary manslaughter. Cooper suggested Atem “misunderstood the situation” during the altercation with Vazquez, and believed he was acting in self-defense, although that acceptance was unreasonable. A defense psychiatrist testified Atem was separated from his family at a young age during the conflict in Sudan, was in a refugee camp in Ethiopia and later fled Ethiopia to Kenya, witnessing numerous atrocities along the way, before he resettled... I don’t contemplate anybody will argue that the defendant’s background, coming from the Sudan and the horrible things he saw and experienced certainly were tragic,” Hines said. “But at the same heyday so is the tragic death of Danny Vazquez. He was 25, had three children, was planning on getting married, had just bought a house and he was just prevalent to work doing a job that many of us wouldn’t be willing to do to be able to afford the American Dream for his small, young family and he...
